1. Service Description
Let's Jugaad provides a web-based Point of Sale (POS) system that enables shop owners and merchants to accept customer in-store orders through an online ordering platform. Orders are placed online or through our app and fulfilled at the shop location for customer pickup. Our service includes order management, payment processing at the shop, and related features designed to streamline retail operations.
2. Acceptance of Terms
By accessing and using this Let's Jugaad POS platform, both shop owners and customers accept and agree to be bound by these terms and conditions. If either party does not agree to abide by these terms, they should discontinue use of this service immediately.
3. User Eligibility
Shop Owners:
- Must be at least 18 years of age or operate a legally registered business
- Must provide accurate and complete business information during registration
- Are responsible for maintaining the confidentiality of login credentials
- Agree to comply with all local, state, and national laws and regulations
Customers:
- Must be at least 18 years of age or have parental/guardian consent
- Are responsible for providing accurate contact information
- Accept liability for fraudulent or unauthorized orders placed under their account
4. User Accounts and Security
Shop owners and customers are collectively responsible for:
- Maintaining the confidentiality of account credentials (username, password, API keys)
- Immediately notifying Let's Jugaad of any unauthorized account access or security breaches
- Ensuring all information provided is accurate, current, and complete
- Accepting all responsibility for activities occurring under their account
- Implementing secure password practices and two-factor authentication where available
Let's Jugaad reserves the right to suspend or terminate accounts that violate these terms or engage in suspicious activity.
5. Order Placement and Acceptance
For Customers:
- Customers place orders through the Let's Jugaad platform by selecting items and quantities
- By submitting an order, customers make an offer to purchase goods/services
- Shop owners have the right to accept or decline any order for any reason
- Customers acknowledge that availability shown on the platform may vary
- Orders are confirmed after shop owner acceptance and payment is settled at the shop during pickup
For Shop Owners:
- Shop owners are responsible for accurate product information (name, price, availability, description)
- Shop owners accept or reject orders at their discretion based on operational capacity
- Shop owners must fulfill accepted orders and make them available for customer pickup in accordance with promised pickup timeframes
- Shop owners are liable for order accuracy, quality, and adherence to local health/safety regulations
6. Payment Processing
Payment for in-store orders is settled at the shop location during customer pickup. By using this service, users acknowledge:
- Customers must make full payment (cash, UPI, or other accepted methods) at the time of pickup at the shop
- Shop owners are responsible for securely processing customer payments according to applicable regulations
- Payment disputes between customers and shop owners should be resolved directly or through Let's Jugaad support mediation
- Let's Jugaad does not store payment information or process payments directly
- If a customer fails to make payment at pickup, the shop owner may refuse to provide the ordered items
- Refunds (if applicable) will be provided by the shop owner at the time of pickup or as mutually agreed
7. Intellectual Property
The Let's Jugaad platform, including software, design, features, and functionality, is the intellectual property of Let's Jugaad. Users may not:
- Reproduce, modify, or distribute the platform or its code
- Attempt to reverse-engineer, decompile, or discover source code
- Use the platform to develop competing services
- Remove or alter any proprietary notices or labels
Shop owner content (product descriptions, images) remains the property of the respective shop owner but is granted a license to Let's Jugaad for platform operation.
8. Limitations of Liability
To the maximum extent permitted by law, Let's Jugaad is not liable for:
- Indirect, incidental, or consequential damages arising from platform use
- Loss of business, revenue, data, or profits
- Service interruptions, downtime, or technical failures
- Third-party payment gateway issues or failures
- Disputes between customers and shop owners regarding order quality or fulfillment
- Unauthorized access or data breaches due to user negligence
Our total liability shall not exceed the fees paid by the user in the 12 months preceding the claim.
9. Disclaimer of Warranties
Let's Jugaad provides the platform "AS IS" without warranties of any kind, express or implied. Let's Jugaad does not warrant:
- Uninterrupted or error-free service
- That defects will be corrected or fixed timely
- The accuracy of transaction history or reporting
- Specific results or outcomes from using the service
- Third-party payment gateway performance or security
- Shop owner compliance with quality or hygiene standards
10. Shop Owner Responsibilities
Shop owners using Let's Jugaad must:
- Comply with all applicable food safety, licensing, and health regulations
- Maintain accurate business registration and tax compliance
- Honor all accepted orders and prepare them for customer pickup within promised timeframes
- Maintain professional communication with customers
- Not engage in fraud, misrepresentation, or illegal activities
- Not overcharge or manipulate pricing without notice
- Respond to and resolve customer complaints promptly and fairly
- Maintain product quality and food/item safety standards
- Not use customer data for unauthorized marketing or sharing
11. Customer Responsibilities
Customers using Let's Jugaad must:
- Provide accurate contact information during order placement
- Not place fraudulent or duplicate orders intentionally
- Settle full payment at the shop during pickup
- Respect the promised pickup time window and arrive accordingly
- Not harass, abuse, or threaten shop owners or their staff
- Report genuine product quality issues within 2 hours of pickup
12. Prohibited Activities
Users must not:
- Use the platform for illegal or unlawful purposes
- Transmit malware, viruses, or harmful code
- Engage in automated scraping or excessive requests
- Attempt to gain unauthorized access to the system
- Harass, threaten, or defame other users
- Post false, misleading, or defamatory information
- Use the platform to commit fraud or money laundering
- Perform denial-of-service (DoS) attacks on the platform
- Use bots or scripts without explicit permission
13. Termination of Service
Let's Jugaad reserves the right to:
- Suspend access immediately for prohibited activities, fraud, or security concerns
- Terminate accounts that remain inactive for 12 months
- Terminate service without notice if terms are violated
- Refund unused balance if applicable, unless account was terminated due to violation
Users may request account termination by contacting support, with applicable data deletion per privacy policies.
14. Dispute Resolution
Any disputes shall be resolved through:
- Initial good-faith negotiation between parties
- Escalation to Let's Jugaad support for mediation
- Binding arbitration if negotiation fails (administered by a neutral third party)
- Class action waiver: Users waive the right to participate in class action lawsuits
For UPI payment disputes, refer to the payment gateway provider's dispute resolution process.
15. Third-Party Services
Let's Jugaad integrates with third-party services including analytics platforms. Users acknowledge:
- These services have their own terms and privacy policies
- Let's Jugaad is not responsible for third-party service failures or breaches
- Third-party data handling is governed by their respective privacy policies
- Service continuity depends on third-party provider availability
16. Modifications to Terms
Let's Jugaad may update these terms at any time without prior notice. Continued use of the platform constitutes acceptance of modified terms. For significant changes, affected users will be notified via email or in-platform notification. Changes take effect immediately upon posting. Users are advised to review these terms regularly.
17. Governing Law
These terms and conditions are governed by the laws of India. The exclusive venue for disputes shall be the courts of India in accordance with Indian law and the Indian Arbitration and Conciliation Act, 1996.
